Terms of Service

The ground rules for using Notifirm, written to be read. Accounts, billing, patient consent, and what each of us is responsible for.

Agreement to these terms

These terms are an agreement between you and Notifirm. By creating an account or using the service, you agree to them. If you are accepting on behalf of a practice, you confirm that you are authorized to bind that practice. If you do not agree, please do not use Notifirm.

The service

Notifirm sends appointment reminders, handles two-way patient messaging, fills cancelled slots from a waitlist, records no-show and late-cancel fees, and reports on all of it. We may add, change, or remove features over time to keep improving the product. If we plan to retire something you rely on, we will give reasonable notice.

Your account

You are responsible for your account and for keeping your sign-in details secure. Keep your team list current, and let us know promptly if you believe an account has been compromised.

  • Provide accurate information and keep it up to date.
  • You are responsible for activity that happens under your account and your team's accounts.
  • Do not share credentials, and use a unique, strong password.

Acceptable use

When using Notifirm, you agree not to:

  • Break the law or use the service to send unlawful, deceptive, or harassing messages.
  • Message people who have not consented to hear from your practice.
  • Attempt to access data that is not yours, or probe, scan, or disrupt the service.
  • Reverse engineer, resell, or copy the service except as the law expressly allows.
  • Upload malware or use Notifirm to harm others.

Customer data and protected health information

You own the data you put into Notifirm, including patient information. You grant us the rights needed to host and process that data so we can provide the service to you.

Because your patient data is protected health information, Notifirm acts as your HIPAA Business Associate and operates under a Business Associate Agreement. Our handling of that data is described on our HIPAA page and in our Privacy Policy.

Patient messaging and consent

You are responsible for having the patient consent required to send text messages and emails, including the consent required by laws such as the TCPA and by carrier rules. Notifirm gives you the tools to honor opt-outs, and patients can reply STOP to stop messages at any time, but the duty to obtain and keep proof of consent rests with your practice.

Plans, billing, and trials

Paid plans are billed monthly through Stripe. Each plan starts with a 14-day free trial, and a payment method is required to begin it. If you do not cancel before the trial ends, your plan converts to a paid monthly subscription and your card is charged. You can cancel anytime during the trial and you won't be charged.

  • Subscriptions renew automatically each month until you cancel.
  • Plan prices and message allowances are shown on our pricing page and may change with notice.
  • Fees are billed in advance and, except where the law requires otherwise, are non-refundable.
  • You are responsible for any taxes that apply to your subscription.

Cancellation and termination

You can cancel your subscription at any time from your billing settings. Cancellation stops the next renewal, and you keep access through the end of the period you have paid for. We may suspend or end access if you breach these terms or use the service in a way that puts patients, other customers, or the service at risk. On termination you can export your data for a reasonable period before it is deleted.

Disclaimers

Notifirm is provided on an as-is and as-available basis. We work hard to keep the service reliable and secure, but we do not promise it will be uninterrupted or error free. Notifirm is a communication and scheduling tool. It is not a medical device and does not provide medical advice.

Limitation of liability

To the fullest extent allowed by law, Notifirm is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

Changes to these terms

We may update these terms as the product and the law evolve. When we make a material change, we will update the date above and let you know in the app or by email. If you keep using Notifirm after a change takes effect, you accept the updated terms.
